CORTE DE APELACIONES SALA 2 Caracas, 14 de Abril de 2.008 197º y 149º PONENTE: OSWALDO REYES CAMACHO EXPEDIENTE Nº 2532 Corresponde pronunciarse sobre pruebas en la presente incidencia, en la que el abogado: JUAN CARLOS GUTIÉRREZ AMARO, suscribió Acta de Inhibición, en su condición de JUEZ CUADRAGÉSIMO SÉPTIMO DE PRIMERA INSTANCIA EN FUNCIONES DE CONTROL DEL CIRCUITO JUDICIAL PENAL DEL ÁREA METROPOLITANA DE CARACAS, respecto a seguir conociendo la causa Nº 9899-07, de la nomenclatura de ese Juzgado, con sustento en el numeral 7° del artículo 86 del Código Orgánico Procesal Penal. DE LAS PRUEBAS El Juez inhibido: JUAN CARLOS GUTIÉRREZ AMARO, no promovió formalmente prueba alguna, pero acompañó a su informe copias simples de: 1°) Audiencia de Presentación de la aprehendida: ROSA MILAGRO ÁLVAREZ SERRANO, por ante el JUZGADO SEGUNDO DE PRIMERA INSTANCIA EN FUNCIONES DE CONTROL DEL CIRCUITO JUDICIAL PENAL DEL ÁREA METROPOLITANA DE CARACAS a cargo del abogado: JUAN CARLOS GUTIÉRREZ AMARO, en fecha 9 de Mayo de 2.007 (Folios 4 al 13). 2°) Resolución Judicial en la cual el JUZGADO SEGUNDO DE PRIMERA INSTANCIA EN FUNCIONES DE CONTROL DEL CIRCUITO JUDICIAL PENAL DEL ÁREA METROPOLITANA DE CARACAS a cargo del abogado: JUAN CARLOS GUTIÉRREZ AMARO, dicta Medida Judicial Privativa Preventiva de Libertad a la imputada: ROSA MILAGRO ÁLVAREZ SERRANO, fechada por error material 9-5-06, cuando lo correcto es 9-5-07 (Folios 14 al 34). Dentro del término establecido en el artículo 96 del Código Orgánico Procesal Penal, SE ADMITEN los medios probatorios anexados por el inhibido, por no aparecer en principio evidentemente impertinentes o ilegales; a los fines de su debida apreciación en la Sentencia Definitiva. Y ASÍ EXPRESAMENTE SE DECIDE. DISPOSITIVA Esta SALA 2 DE LA CORTE DE APELACIONES DEL CIRCUITO JUDICIAL PENAL DEL ÁREA METROPOLITANA DE CARACAS, administrando Justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley, emite el siguiente pronunciamiento: ÚNICO: SE ADMITEN los medios probatorios aludidos por JUAN CARLOS GUTIÉRREZ AMARO, en su condición de JUEZ CUADRAGÉSIMO SÉPTIMO DE PRIMERA INSTANCIA EN FUNCIONES DE CONTROL DEL CIRCUITO JUDICIAL PENAL DEL ÁREA METROPOLITANA DE CARACAS, por no aparecer en principio evidentemente impertinentes o ilegales a los fines de su debida apreciación en la Sentencia Definitiva. Todo con sustento en el numeral 7° del artículo 86 del Código Orgánico Procesal Penal. Publíquese, regístrese y déjese copia.
