Por todas las consideraciones expuestas este Tribunal Tercero (3°) Superior del Trabajo del Circuito Judicial del Trabajo del Área Metropolitana de Caracas, en nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, declara: PRIMERO: SIN LUGAR EL RECURSO DE APELACIÓN INTERPUESTO POR LA REPRESENTACIÓN JUDICIAL DE LA PARTE ACTORA, SEGUNDO: SE CONFIRMA LA DECISIÓN RECURRIDA PROFERIDA POR EL JUZGADO DÉCIMO TERCERO (13º) DE PRIMERA INSTANCIA DE JUICIO DEL CIRCUITO JUDICIAL DEL TRABAJO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, EN FECHA 10 DE AGOSTO DE 2009, TERCERO: NO HAY ESPECIAL CONDENATORIA EN COSTAS, TODO EN EL JUICIO INCOADO POR EL CIUDADANO JUAN PAEZ CABRERA CONTRA CANTV, AMBAS PARTES PLENAMENTE IDENTIFICADAS EN AUTOS.-

Por todas las consideraciones anteriormente expuestas, este Tribunal Tercero (3°) Superior del Trabajo del Circuito Judicial del Trabajo del Área Metropolitana de Caracas, administrando justicia en nombre de la República Bolivariana de Venezuela y por expresa autoridad de la ley, DECLARA: PRIMERO: SIN LUGAR EL RECURSO DE APELACIÓN INTERPUESTO POR LA REPRESENTACIÓN JUDICIAL DE LA PARTE DEMANDADA, SEGUNDO: SE CONFIRMA LA DECISIÓN RECURRIDA PROFERIDA POR EL JUZGADO DÉCIMO TERCERO (13º) DE PRIMERA INSTANCIA DE SUSTANCIACIÓN, MEDIACIÓN Y EJECUCIÓN DEL CIRCUITO JUDICIAL DEL TRABAJO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, EN FECHA 11 DE AGOSTO DE 2009, TERCERO: SE CONDENA EN COSTAS A LA PARTE DEMANDADA, todo en el juicio incoado por los ciudadanos RODOLFO ENRIQUE ACOSTA RIVERA, JONAS RAFAEL VERA MUÑOZ, RAFAEL HERNANDEZ, KELVIN JOSE SEGOVIA ACOSTA, VICTOR JOSÉ PALACIOS CANELÓN, JOSE RAFAEL CLEMENTE, FERNANDO MARTÍNEZ RONDON, JUAN DE JESUS MONGES, ELVIS PEÑA ESPINOZA,.....
