Por todas las consideraciones anteriormente expuestas, este Tribunal Tercero (3°) Superior del Trabajo del Circuito Judicial del Trabajo del Área Metropolitana de Caracas, administrando justicia en nombre de la República Bolivariana de Venezuela y por expresa autoridad de la ley, DECLARA: PRIMERO: SIN LUGAR EL RECURSO DE APELACIÓN INTERPUESTO POR LA REPRESENTACIÓN JUDICIAL DE LA PARTE ACCIONANTE, SEGUNDO: SE CONFIRMA LA DECISIÓN RECURRIDA DICTADA POR EL JUZGADO CUADRAGÉSIMO (40º) DE PRIMERA INSTANCIA DE SUSTANCIACIÓN, MEDIACIÓN Y EJECUCIÓN DEL CIRCUITO JUDICIAL DEL TRABAJO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, EN FECHA 19 DE OCTUBRE DE 2009, TERCERO: NO HAY ESPECIAL CONDENATORIA EN COSTAS.-

Por todas las consideraciones anteriormente expuestas, este Tribunal Tercero (3°) Superior del Trabajo del Circuito Judicial del Trabajo del Área Metropolitana de Caracas, administrando justicia en nombre de la República Bolivariana de Venezuela y por expresa autoridad de la ley, DECLARA: PRIMERO: SIN LUGAR EL RECURSO DE APELACIÓN INTERPUESTO POR LA REPRESENTACIÓN JUDICIAL DE LA PARTE ACCIONADA, SEGUNDO: SE CONFIRMA LA DECISIÓN RECURRIDA DICTADA POR EL JUZGADO VIGÉSIMO SEPTIMO (27º) DE PRIMERA INSTANCIA DE SUSTANCIACIÓN, MEDIACIÓN Y EJECUCIÓN DEL CIRCUITO JUDICIAL DEL TRABAJO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, EN FECHA 07 DE AGOSTO DE 2009, TERCERO: NO HAY ESPECIAL CONDENATORIA EN COSTAS.
